๐Ÿ‡ฑ๐Ÿ‡ธJurisdiction Guide

Your customer or buyer is asking for ESG information about Lesotho supply chains. Here is what the regulatory environment requires.

Lesotho is a small landlocked kingdom entirely surrounded by South Africa โ€” one of only three countries in the world that are entirely surrounded by another country (the others being San Marino and Vatican City, both surrounded by Italy). It is known as the 'Kingdom in the Sky' due to its high altitude โ€” it is the only country in the world with its entire territory above 1,000 metres. Lesotho has a significant garment and textile manufacturing sector, producing for US and EU markets under AGOA and the EU GSP. The country also exports water to South Africa through the Lesotho Highlands Water Project โ€” one of the world's largest water transfer schemes. Lesotho has one of the world's highest HIV/AIDS prevalence rates.

Key regulations in Lesotho โ€” ESG Supplier Guide

EU CSRD โ€” Garment Supply Chains

In Force
CSRD applies to large EU companies from FY2024 reporting. EU fashion companies sourcing from Lesotho face supply chain reporting requirements.

Lesotho is a significant garment exporter โ€” particularly denim and knitwear. EU fashion companies sourcing from Lesotho face CSRD supply chain reporting requirements. Key ESG issues include: labour rights in garment factories, HIV/AIDS workplace policies (Lesotho has one of the world's highest HIV prevalence rates at approximately 23% of adults), living wages, and working conditions. Lesotho's garment sector has been the subject of significant labour rights campaigns.

EU CSDDD โ€” Labour Rights

Upcoming
CSDDD transposition deadline: July 26, 2028.

EU companies sourcing from Lesotho will be required under CSDDD to conduct human rights and environmental due diligence. Key ESG issues include: labour rights in garment supply chains, HIV/AIDS workplace policies, living wages, and freedom of association.

Water Security โ€” Lesotho Highlands Water Project

In Force
Ongoing. The Lesotho Highlands Water Project is a major water security infrastructure.

The Lesotho Highlands Water Project transfers water from Lesotho's highlands to South Africa's Gauteng province (Johannesburg/Pretoria). This is a significant ESG consideration for companies with South African supply chains that depend on Gauteng water supply. Phase 2 of the project is under construction. Water security is an increasingly material ESG risk under CSRD.

Lesotho Data Protection & Cyber Obligations

In Force
See description for jurisdiction-specific dates and deadlines.

Lesotho's Data Protection Act 2012 provides basic data protection obligations. The Lesotho Communications Authority (LCA) oversees telecommunications. Mandatory breach notification requirements are not yet fully codified. International buyers from the EU, UK, or USA will assess Lesotho suppliers against their own data protection standards under CSRD and CSDDD supply chain due diligence. Suppliers should implement incident response procedures aligned with international best practice.

What this means for you as a supplier

Lesotho is a medium-risk jurisdiction. Garment exporters face CSRD supply chain reporting from EU fashion buyers โ€” HIV/AIDS workplace policies, living wages, and labour rights are key ESG issues. The Lesotho Highlands Water Project is a significant ESG consideration for South African supply chains. CSDDD due diligence will be required from 2029.

Lesotho's garment sector: a living wage case study

Lesotho's garment sector employs approximately 40,000 workers โ€” predominantly women โ€” in factories producing denim, knitwear, and other garments for US and EU brands. The sector has been the subject of significant labour rights campaigns, including the "Mothers of Lesotho" campaign which highlighted sexual harassment and abuse in garment factories. Living wage campaigns have focused on Lesotho as a case study: the minimum wage in Lesotho's garment sector is significantly below the estimated living wage, and brands sourcing from Lesotho have faced pressure to commit to living wage payment. Under EU CSRD and CSDDD, EU fashion companies sourcing from Lesotho must assess and disclose their approach to living wages in their supply chains. Lesotho's garment sector is also notable for its relatively high proportion of women in management roles compared to other African garment-producing countries โ€” a positive ESG indicator. The country's AGOA eligibility (which provides duty-free access to the US market) and EU GSP status make it an attractive sourcing destination for brands seeking African supply chain diversification.
